Bihati Solutions has filed a R1,7bn suit against Telkom, saying the delay has affected its revenues adversely, this according to South African publication Business Day.
“We are suing for revenue losses and that has a massive impact on our business,” explained Malikhanye Mabena, Biharti Executive.
A total of six companies were involved in building a network for the South African telecoms giant. Bihati should have earned around R1bn from the tender valued at R2,7bn.
Telkom claims the validity period has expired and therefore the tender is no longer valid, while Bihati argues it was signed within the agreed time. No reasons were given for the delay from Telkom’s side.
“The application will be based inter alia on the fact that the purported decision to award the tender was made outside the validity period”, said Telkom’s officials in a statement, announcing they would apply for a court order to review the tender awarding decision.
Bihati had been in talks with Telkom since April 2009 until Tuesday last week, when Bihati’s legal counsel told Telkom of its intention to file a suit,
